Welcome to vshealthbenefits.com (the "Site"), operated by VS Health Benefits ("VS Health Benefits," "we," "our," or "us"), an independent licensed health insurance producer based in Miami, Florida. By using the Site, requesting a quote, contacting us, or using our Client or Admin portals, you agree to these Terms & Conditions (the "Terms"). If you do not agree, please do not use the Site.
You must be at least 18 years old and legally able to enter contracts to use the Site. By using the Site you represent that the information you provide is accurate and that you are using the Site for your own benefit or as an authorized representative of an employer or family member.
VS Health Benefits provides independent insurance advisory and brokerage services, including:
Our consultations are free of charge to you. We are compensated by the insurance carriers when a policy is placed, in accordance with state insurance regulations and disclosure rules.
VS Health Benefits is a licensed insurance producer and not an insurance company. Insurance policies are issued by the carriers. All coverage, premiums, deductibles, networks, exclusions, and benefits are determined by the carrier and the underlying policy contract. The carrier - not VS Health Benefits - is responsible for paying claims, making coverage decisions, and administering the policy.
Some features of the Site (Client and Admin portals) require you to register an account. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.
You agree not to:
By submitting a form or contacting us, you consent to receive communications from VS Health Benefits by email, phone, and text message (including via automated technology, where applicable) at the contact details you provide, for the purpose of responding to your inquiry, providing quotes, scheduling appointments, completing applications, and servicing your policy. Consent to receive text messages is not a condition of purchasing any goods or services.
When you opt in to text messaging from VS BENEFITS LLC, d/b/a VS Health Benefits, you can expect to receive conversational and customer-care messages related to your inquiry or coverage — for example quote follow-ups, appointment confirmations and reminders, document requests, renewal reminders, and occasional informational messages.
You can opt out of marketing emails at any time by clicking the unsubscribe link or emailing us. Transactional messages tied to an active policy or application may continue until the relationship ends.
The Site, including its text, graphics, logos, layout, photography, code, and the "VS Health Benefits" name and brand, is owned by VS Health Benefits or its licensors and is protected by U.S. and international intellectual property laws. You may use the Site for personal, non-commercial purposes related to evaluating and purchasing insurance. You may not copy, reproduce, modify, or distribute any part of the Site without our prior written permission, except where allowed by law.
The Site may link to third-party websites, carriers, government portals (such as HealthCare.gov), and tools (such as scheduling, payment, or e-signature). We do not control these third parties and are not responsible for their content, terms, or privacy practices. Your use of any third-party site or service is at your own risk and governed by that third party's terms.
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. While we make a reasonable effort to keep information current, insurance products, premiums, networks, regulations, and program rules change frequently. Nothing on the Site is intended as legal, tax, medical, or financial advice. Please consult your own qualified advisor for those questions.
To the fullest extent permitted by law, VS Health Benefits, its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Site or our services. Our total cumulative liability for any claim arising out of or relating to the Site or our services will not exceed the amount you have paid us in the 12 months preceding the claim (which, for most consumers, is zero, since carriers compensate us). Some jurisdictions do not allow certain limitations - in that case, the limitations apply to the maximum extent permitted.
You agree to defend, indemnify, and hold harmless VS Health Benefits and its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your misuse of the Site, (c) any false or misleading information you submit, or (d) your violation of any law or third-party right.
We may suspend or terminate your access to the Site or our portals at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. You may stop using the Site at any time. Sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any right you may have to file a complaint with a state insurance department or other regulator.
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted means you accept the updated Terms. If you do not agree with the changes, please stop using the Site.
